John-Paul Zubec

J.P.’s areas of practice include labour law, employment law, other civil litigation including personal injury, and wills and estates. He has appeared before the Federal Court of Appeal, Divisional Court and Superior Court of Justice and has represented clients in proceedings before the Canada Industrial Relations Board, Ontario Labour Relations Board and the Ministry of Labour.

J.P. is from Winnipeg, Manitoba and has undergraduate degrees in Music and Education from the University of Manitoba. He worked as an instrumental music and history teacher before leaving the teaching profession to referee professional hockey. J.P. received his law degree from the University of Western Ontario, where he was awarded the Torkin Manes Cohen & Arbus award and worked as a Program Manager at Sport Solution, a clinic that assists Olympic and National Team athletes with legal issues related to selection, discipline and carding. During his tenure at Sport Solution, J.P. made submissions on behalf of athletes in ad hoc appeal hearings administered by various national sport organizations. J.P. articled with a national law firm and was called to the Bar in 2003.

J.P.’s recent successes include the following:

  • He represented a lawyer in a bitterly fought wrongful dismissal trial before the Superior Court of Justice. The Court held that the opposing party, who was a well known senior litigation lawyer in Ottawa, attempted to avoid liability by adopting tactics that included: ambushing J.P. and his client at trial by raising an argument that had not been disclosed and refusing to produce relevant documents. Notwithstanding these obstacles, the defendant was ordered to pay J.P.'s client damages and, because of the defendant's misconduct, the defendant was ordered to pay J.P.'s client an amount in legal costs that was nearly five times the damages award.
  • He successfully argued a case before the Divisional Court of Ontario on behalf of a graduate student who was required to withdraw from her studies at the University of Ottawa. The Court ruled in favour of J.P.'s client and ordered the University of Ottawa to re-register his client and pay her legal costs.
  • He argued a case before the Ministry of Labour and obtained an order that an employer pay his client over eights months pay plus damages for pain and suffering because it dismissed her when she was returning from a maternity leave.
  • He argued a second case before the Ministry of Labour and obtained an order that an employer pay his client – who was a modestly paid employee with a short service record - $16,400.00 because it dismissed him as he was returning from parental leave.
