YOUR RIGHTS
Many employers provide their employees with benefit packages, which include short and long term disability benefits. In addition to any benefits that you may have as an employee, you may also be entitled to compensation from the Workplace Safety and Insurance Board, Employment Insurance sickness benefits, the Canada Pension Plan disability benefit or the Ontario Disability Support Plan disability benefit.
To fully understand your legal rights, it is important to understand the effects of your sickness and disability on your ability to work both now and in the future. In addition, it is important to understand the options available to you either through private insurance plans or benefits provided to you by the state.
PROTECTING YOUR RIGHTS
If you become sick or disabled and are unable to work, you should gather as much medical information as you can with respect to the nature and extent of your illness or disability. Once you have information on the nature and extend of your illness or disability, you will be in a better position to identify the options that are available to you.
You should obtain a copy of any benefit plan that you have at work, as well as a copy of the conditions that are associated with the award of the benefits under the plan. You should also note the definition of "disability" under the plan as well as any time restrictions for filing an application for benefits.
If you do not have access to private insurance you should consider the other options available to you. If you were injured during the course of your employment, you should investigate whether you are entitled to compensation form the Workplace Safety and Insurance Plan. If your disability prevents you from working at any position, you may be eligible for benefits under the Canada Pension Plan or the Ontario Disability Support Plan.
