YOUR RIGHTS
High Technology Employment relationships are unique. There are often issues surrounding non-competition clauses and stock option agreements before, during and after the employment relationship.
If you have been terminated from your employment and you were actively recruited from prior employment you may be entitled to compensation above and beyond severance and pay in lieu of reasonable notice. If you were induced to leave gainful employment by your new employer, and have been terminated, your legal entitlement may increase significantly.
PROTECTING YOUR RIGHTS
If you have been dismissed by your employer or have been demoted to a position significantly junior to your prior position without just cause, you should contact a lawyer immediately. It is important not to accept any offer of compensation for termination without first obtaining independent legal advice. You can usually obtain a preliminary legal opinion on a termination package for less than a few hundred dollars.
A lawyer can advise you as to your rights and entitlements under your employment contract and stock option agreement. More importantly, a lawyer may be able to negotiate more favourable terms such as an acceleration of unvested stock options, increased pay in lieu of notice and/or severance and/or a release from a non-competition clause.
