YOUR RIGHTS
If you sustain an injury in a motor vehicle accident you may be entitled to compensation from your automobile insurer for your losses. If you do not have automobile insurance you may have a right to be compensated by the insurance of the drivers involved in the collision or through a family member's insurance.
Ontario has legislated benefits called Statutory Accident Benefits (SAB's) that auto insurer's are obligated to provide to eligible persons injured in collisions. If you are injured in an accident you may be entitled to income replacement benefits, caregiver benefits, medical benefits, rehabilitation benefits and/or attendant care benefits. You may also be entitled to recover lost educational expenses, visitor expenses, housekeeping and home maintenance expenses, and other various expenses incurred as a result of your injury.
In addition to the Statutory Accident Benefits, you may have grounds to claim damages in court if you were not at fault for the accident and have suffered a serious and permanent injury. Those damages include compensation for your pain and suffering, loss of enjoyment of life, loss of income, and loss of household and handyman capacity. Your family may also be entitled to damages for loss of care, guidance and companionship under the Ontario Family Law Act.

Your entitlements to Statutory Accident Benefits and your right to sue may expire if you do not meet the strict time limitations set out in the relevant legislation. The extent of injuries may manifest themselves in the weeks and months after an accident, and you should consider protecting your right to apply for benefits and/or sue as soon after an accident as possible.
